4. Payment & Refund Policy

4.1 Payment Terms

  • Payment is required as per the terms outlined in the service agreement or invoice.
  • We accept payments in USD ($) or other mutually agreed currencies.
  • Failure to make timely payments may result in service suspension or termination.

4.2 Refund Policy

  • Due to the nature of our services, all payments are final and non-refundable unless explicitly stated otherwise in a signed agreement.
  • If a project is terminated before completion, refunds are at the discretion of AGHORI LABS based on the work completed.

5. Data Security & Third-Party Services

AGHORI LABS does not store client data on private servers. Any data processed through our services is stored on third-party platforms, such as:

  • Shopify – For eCommerce store data
  • Google Analytics, Facebook Pixel, Microsoft Clarity – For tracking and analytics
  • Payment Gateways (Stripe, PayPal, etc.) – For secure transactions

We are not responsible for any data breaches or privacy issues caused by these third-party services. Clients are encouraged to review their respective privacy policies.

6. Client Responsibilities

By engaging with AGHORI LABS, you agree to:

  • Provide accurate business details and necessary credentials for project execution.
  • Respond to inquiries and deliverables in a timely manner to ensure smooth project execution.
  • Ensure compliance with applicable data protection laws when sharing customer data with AGHORI LABS.

Failure to provide necessary access or approvals may result in delays or service termination without refund.

7. Limitation of Liability

AGHORI LABS provides services “as is” and without warranties of any kind. We do not guarantee that:

  • Our services will meet your specific business needs.
  • The Site will be error-free or uninterrupted.
  • Any third-party services integrated into your Shopify store will function without issues.

Under no circumstances shall AGHORI LABS, its employees, affiliates, or partners be liable for direct, indirect, incidental, or consequential damages arising from the use of our Site or services.

8. Dispute Resolution & Governing Law

  • These Terms of Service shall be governed by and construed in accordance with the laws of West Bengal, India.
  • Any disputes shall first be attempted to be resolved through mediation. If unresolved, disputes shall be submitted to binding arbitration under the Indian Council of Arbitration (ICA) in West Bengal, India.

9. Termination of Services

We reserve the right to terminate your access to the Site or our services at any time, with or without notice, if we determine that you have violated these Terms of Service.

10. Use of Client’s Logo & Work Portfolio

By engaging with AGHORI LABS, clients grant us permission to use their business name and logo for promotional purposes. If a client wishes to opt out, they may contact [email protected].

The Site may contain links to third-party websites. AGHORI LABS is not responsible for the content, privacy policies, or services of these third-party sites.
